The Fourie judgment found the prohibition on same-sex marriage unconstitutional (and therefore invalid) and allowed Parliament a year to rectify this. In that year the government was to ensure that it can cater for same-sex marriages. As much as the ANC MP’s voted in favour of the Civil Unions Act, same-sex marriages/ unions would have been recognized and given largely equality status by the end of 2006.

Let’s not make character attacks on Justices of the Constitutional Court – we have politicians doing that already.
