It has been reported in India’s media that the government is set to accept a recent Delhi High Court ruling which legalised homosexuality.
In July, the High Court ruled to overturn the 100 year old ban on gay sex under Section 377 of the Indian penal code.
While the ruling is only officially binding in the city of New Delhi, it set a precedent that effectively extends the judgment to the rest of the country.
Now, according to a leaked note, the cabinet has recommended the government accept the ruling. It is believed that Prime Minister Manmohan Singh also supports this position.
The note says that there appears to be no “legal error” in the court’s judgment which stated that the criminalisation of gay sex among consenting adults is a violation of fundamental rights.
The Delhi High Court ruling has been challenged by a number of religious groups who will this month present their arguments to the Supreme Court.
