Those opposing same-sex marriage are raising their concern after it was revealed that the judge presiding over the Prop 8 case in California is himself gay.

While Judge Vaughn Walker’s sexuality was never kept hidden, the issue only came to light after the San Francisco Chronicle made the fact widely known in an article on Sunday.

The newspaper described this as “the biggest open secret” in the landmark trial in which two same-sex couples are suing to overturn California’s Proposition 8 same-sex marriage ban.

The conservative National Organization for Marriage was quick to slam the judge. “We have no idea whether the report is true or not. But we do know one really big important fact about Judge Walker: He’s been an amazingly biased and one-sided force throughout this trial, far more akin to an activist than a neutral referee. That’s no secret at all,” it said in a statement.

Attorney Andrew Pugno, who is representing the backers of Prop 8, told the Chronicle that his team did not intend bring up the judge’s sexuality in the case, asserting, “We are not going to say anything about that”.

Walker (65), who has refused to comment on the matter, was chosen to judge the case at random, and it has been noted that he has ruled against gays in previous cases.
